About the course
This course has been designed in consultation with experienced practitioners, for solicitors and barristers intending to specialise in intellectual property practice.
The course is intended for recently qualified solicitors or barristers, and those new to the practice of intellectual property who want to develop and extend their skills beyond the rapid acquisition of knowledge to a thorough understanding of the law and practice relating to the creation, validity and infringement of intellectual property. The course will benefit lawyers working in-house or in private practice.
During the course experienced barristers and solicitors will cover the more complex elements of the law as well as its practical application, including:
- comprehensive treatment of all categories of IP law in a commercial context
- hands on exposure to litigation processes in IP disputes tutored by experienced barristers
- interplay between IP law, competition and tax regimes with specialist guest lectures
- practical experience of IP related transactions.
The course is held in London over four extended study weekends totalling ten days over a four month period. The sessions will be grouped into blocks in order to fit in with busy schedules, minimise time spent away from the office and provide breaks for reflection between the more intensive learning experience of each block.
Successful completion of the diploma will offer the opportunity to transfer to the LLM in Commercial Intellectual Property.

The introduction to intellectual property module runs for two days and covers the following:
- the philosophy underlying Intellectual Property (IP) rights
- categories of IP right, transactions affecting IP rights and features of the law substantially common to all categories of IP right
- the commercial significance of IP rights and their commercial exploitation
- the creation, scope of protection and enforcement of registered and unregistered design right at national and EU level passing off and trade mark registration, protection and infringement
- an introduction to Copyright Law, Protection and Infringement
- patent rights, specification, validity, infringement, interpretation and claim construction, procedure in relation to the amendment of a patent
- the law of confidentiality and trade secrets
- the application of tax to IP rights.
The rest of the course considers:
- court procedures and rules, evidence, alternative dispute resolution techniques and expert witnesses as they apply to intellectual property
- law on the creation, scope of protection and enforcement of registered and unregistered design right at national and eu level
- law of passing off and trade mark registration, protection and infringement
- Copyright Law, Protection and Infringement
- patent rights, specification, validity, infringement, interpretation and claim construction, procedure in relation to the amendment of a patent
- law of unjustified threats and domain names
- case analysis techniques
- reflective practitioner skills
- commercial significance of IP rights and their commercial exploitation
- role of IP in industries
- patent rights, specification, validity, infringement, interpretation and claim construction, procedure in relation to the amendment of a patent
- application of IP due diligence, investigation and contractual protection involved in, the acquisition/disposal of an IP-owning business
- inter-relationship of tax laws and IP rights of interface between IP rights and principles of competition law and rules.
- ownership, assignments, licences and security interests over IP rights form
- drafting and negotiation of warranties, indemnities, provisions in a business acquisition/disposal and common contractual provisions in IP related contracts.
Assessment
There are no written examinations for the PgDip in Commercial Intellectual Property. The course will be assessed by means of a reflective piece of work applicable to professional practice.
Successful completion of the PgDip in Commercial Intellectual Property enables students to transfer to the LLM in Commercial Intellectual Property. The assessment for this course will be through the proposal and completion of an Extended Piece of Work (EPW).
