The support we provide is in a complex area to those who would otherwise be faced with going alone and would likely, in the case of contentious matters, face detrimental outcomes such as ceasing trading or coming under significant financial strain. This year has seen an increased focus on contentious work, assisting clients whose right to use their name is being challenged, or those who need to enforce their own IP rights.
Case study
We assisted a sole trader who had received a letter from a trade mark owner demanding they change their name, requesting a significant amount of money in reparation, and threatening court proceedings. We assisted with the selection of a new brand and drafted a settlement agreement to bring matters to a close on terms that were significantly improved on that which had been requested, resolving the matter without court proceedings.
