Intellectual Property Service
The Intellectual Property (IP) service focusses on providing IP advice to individuals, start-ups and SMEs who cannot otherwise afford the advice. We are able to assist with enquiries relating to trade marks, designs, and copyright. We have particular expertise with respect to trade mark matters.
IP concerns the protection of your ideas, branding and products. We are able to provide advise relating to a wide range of issues both contentious (such as needing to object to someone else / needing to respond to an objection) and non-contentious (such as securing registered design or trade mark protection).
Please note that we do not currently offer advice or support with respect to patents but can signpost to alternative resources if needed.
We can advise across the full range of issues that might arise. This includes:
- Protecting your rights at the UK Intellectual Property Office (IPO), with assistance from filing through to registration.
- Contentious matters before the IPO such as oppositions and invalidation proceedings.
- Matters relating to infringement, either as claimant or defendant.
- Transactional matters such as assignments.
Case study
We assisted a sole trader who had received a letter from a trade mark owner demanding they change their name, requesting a significant amount of money in reparation, and threatening court proceedings. We assisted with the selection of a new brand and drafted a settlement agreement to bring matters to a close on terms that were significantly improved on that which had been requested, resolving the matter without court proceedings.
